4. Matters Arising from the Minutes not appearing elsewhere on this Agenda

.1 Students’ Union Disciplinary Policy

To receive and note the LSU Disciplinary Policy.

.2 Clarification of Penalties
DISC06-P10 (DISC06-M2, Min. 13.2 refers)

To note a minute of the Committee’s meeting in July 2005 (below), and to receive and consider a paper from the Registrar:-

“The Committee was advised that on a number of occasions Disciplinary Panels had imposed penalties which had included the withdrawal of services provided by the University for which students paid a fee. In some cases students had sought a pro rata refund, and it had become apparent that some fees were automatically forfeit and others were not.

Whilst the Committee was sympathetic to Disciplinary Panels’ intentions that fees should sometimes be forfeit, it did not have the expertise to comment on the various contracts between the University and individual students.

Accordingly, the Registrar AGREED to instigate a review of contracts with students to include, inter alia, tuition, accommodation, sports facilities, computing.”

To note that the Registrar has referred the Committee’s concerns to the Health and Safety Officer, and to the Director of Student Guidance and Welfare.

.4 Statute XIV – Amendment
(DISC06-M2, Min. 13.4 refers)

To note that at its meeting on 28 June 2006 Senate resolved to recommend to Council an amendment to Statute XVI as proposed by the Committee.

.5 Dissemination of Information – Student References
DISC06-P11 (DISC06-M2, Min. 13.5 refers)

To receive and note advice from the University’s solicitor in regard to the impact of disciplinary proceedings on student references.

(Secretary’s Note: As a result of this advice, the outcome of Major Disciplinary hearings is now communicated to a student’s Head of Department.)

.6 Procedure for Expulsions and Suspensions; Student Disciplinary Appeals Committee

To note that at its meeting on 28 June 2006 Senate received a report in which the Committee’s concerns were expressed.

5. Major Disciplinary Hearings: Autumn 2006

To note that three Hearings have taken place to date, and a further four are scheduled for 2006.

To review any issues arising out of the Hearings to date.
