Subject: Ordinance XXX: Concerning the Composition of the Senate and the Election of Members thereto and to the Court and the Council by the Academic and other staff of the University, by the General Assembly and by Students of the University

1. At its meeting on 29 September 1999 General Assembly was invited to consider whether members would welcome any rescheduling of the election process to Senate. This followed a suggestion that the timetable for the conduct of elections be reviewed so that these did not take place at such a busy time of the year for academic staff as at present.

2. Suggestions by members of General Assembly to improve the situation included the following:

It was intended that suggested amendments to the procedure which required a change in Ordinance would be brought to the November Senate meeting.

3. A draft revised version of Ordinance XXX is attached as Annex A, which includes amendments, shown in capitals, to paras 4,5, 6 & 7. Actual dates for the year 2000 are shown in brackets for information. The changes allow the election process to start and finish earlier, all within Semester time, and the gaps are longer between processes.

4. The current version of Ordinance XXX is attached as Annex B.

5. At its meeting on 5 November 1999 Ordinances and Regulations Committee recommended the revisions to Ordinance XXX to Senate, subject to an amendment which has been incorporated in the attached draft.

The Committee hoped that the suggestion by General Assembly that nominating and seconding should be able to be carried out electronically would be pursued, but noted that this was not a matter for determination by Ordinance.


 Annex A

 

Ordinance XXX. Concerning the Composition of the Senate and the Election of Members thereto and to the Court and the Council by the Academic and other Staff of the University, by the General Assembly and by Students of the University.

Draft Revision

1.

The composition of the Senate shall be in accordance with Statute XIV paragraph 1.

2.

Among the members of the Academic Staff elected pursuant Statute XIV paragraph 1 sub paras. (iii) (a) and (iii) (b) there shall be elected so many professors that they together with the ex-officio members listed in sub-paras. (i) (a) to (e) shall exceed the elected, appointed and co-opted members who are not professors by not fewer than two.

3.

The Manager of Academic Registry shall each year cause to be prepared Electoral Rolls of all those members of the Academic and other staff of the University, the General Assembly and students of the University eligible to participate in the election of members of the Court, the Council and the Senate. There shall be the following Electoral Rolls:

 

(i)

of the General Assembly for the purpose of electing:

(a)
six members of the Academic Staff to the Court pursuant Statute XII sub. para. 1(v)(a)

(b)
three members of the Academic Staff to the Council pursuant Statute XIII sub. para. 1(v)

(c)
four members of the Academic Staff to the Senate pursuant Statute XIV sub. para. (iii)(a)

 

(ii)

of the Academic Staff in each Faculty for the purpose of electing so many of their number to the Senate as shall be determined pursuant Statute XIV sub. para. 1(iii)(b) and Section 5 of this Ordinance

 

(iii)

of the staff of the University excluding all those who are members of the Academic Staff for the purpose of electing:

 

 

(a)

four from their own number to the Court pursuant Statute XII sub para. 1(v)(b)

 

 

(b)

three from their number to the Council pursuant Statute XIII sub para. 1(vi)

 

(iv)

of the students of the University in each Faculty for the purpose of electing one student from each Faculty to Senate pursuant Statute XIV sub. para. 1(iii) (c).

4.

(i)

Draft Electoral Rolls of the General Assembly, the Academic Staff and other staff of the University shall be published each year on the TWELFTH WEDNESDAY OF THE FIRST SEMESTER (19 Jan) and shall be available for inspection until the penultimate FRIDAY OF THE SEMESTER (4 Feb).

 

(ii)

Draft Electoral Rolls of the students of the University shall be published each year on the NINTH WEDNESDAY OF THE FIRST SEMESTER (1 Dec) and shall be available for inspection until the ELEVENTH FRIDAY OF THE SEMESTER (17 Dec).

 

(iii)

Thereafter the Manager of Academic Registry shall cause to be corrected all errors therein and all omissions therefrom which have been drawn to his attention and the draft Electoral Rolls thus amended shall be those from which elections to the Court, the Council and Senate shall be conducted.

(i)

Each year before the commencement of the SECOND SEMESTER (11 Feb) the Manager of Academic Registry shall DETERMINE the number of elected members of the Senate from Faculties for the year beginning 1 August next following, and the Faculty for the year beginning 1 August next following, and the least number of professors thereamong who shall be required to be elected pursuant para 2 of this Ordinance.

 

(ii)

For the purpose of calculating these numbers:

 

 

(a)
he/she shall take the number of ex-officio members of Senate specified in sub. para. 1(i)(e) of Statute XIV (the Heads of Departments) and shall multiply that number by two;

 

 

(b)
from the product of that multiplication he/she shall subtract four in respect of the members of the Senate elected by the General Assembly pursuant sub. para. 1(iii)(a) of Statute XIV and the remainder shall be the total number of members of the Senate derived from Faculties;

 

 

(c)
the number thus obtained shall be divided to the nearest integer between Faculties in proportion to the number of Academic Staff in each Faculty and for each Faculty there shall then be subtracted from the resultant number of each Faculty the number of Heads of Department in that Faculty. The number then remaining shall be the number of elected members for each Faculty except as provided hereafter.

 

 

 

 

 

(iii)

Notwithstanding the provisions of para. 5(ii) of this Ordinance, there shall be not fewer than three elected members from each Faculty. If it be shown that the number of elected members from any Faculty calculated in accordance with para. 5(ii) hereof would have been fewer than three, the total number of Heads of Department in any such Faculty, together with three elected members for any such Faculty shall be subtracted from the number of members of Senate prescribed in sub. para. 5(ii)(b) hereof, and the number remaining shall be divided between those Faculties in respect of which the number of elected members has not been raised to three by virtue of the overriding provisions of this paragraph and the method of dividing them shall be in accordance with the method prescribed in sub. para 5(ii)(c) hereof.

 

(iv)

If by the calculation to the nearest integer of the number of members of Senate from Faculties specified in para. 5(ii) hereof, the aggregate of the elected members of Senate thereby resulting shall exceed or fall short of the number of elected members specified in sub. para. 1(iii)(b) of Statute XIV, the number shall be adjusted as follows:

 

 

(a) if the number falls to be reduced, one place shall be removed from the quota of that Faculty having the largest quota of elected members insofar as that quota has been achieved by rounding up.

 

 

(b) if the number falls to be increased, one place shall be added to the quota of that Faculty having the smallest quota of elected members other than any quota which has been increased to three by the operations of para. 5(iii) hereof.

6.

(i)

The elections of students of the University to Senate with effect from 1 August shall be conducted each year DURING THE SECOND SEMESTER.

 

(ii)

Arrangements for the call and return of nominations and for any necessary ballot shall be determined by the Manager of Academic Registry in consultation with the Sabbatical Secretary of the Students' Union, provided that in each election the period for the return of nominations shall be not less than FIFTEEN days.

 

(iii)

Candidates for election shall be eligible for nominations in accordance with the provisions of Statue XIV and provided that their names are enrolled in the current Electoral Roll of the students of the University.

7.

(i)

Nominations of staff candidates for election to the Court, the Council and the Senate with effect from 1 August shall be called for each year as follows:

 

 

(a) on the first Monday OF THE SECOND SEMESTER (14 Feb) nominations for the election of Academic Staff from the Faculties to the Senate;

 

 

(b) on the fourth Monday OF THE SECOND SEMESTER (6 March) nominations for the election of staff of the University not being members of the Academic Staff to the Court and the Council;

 

 

(c) on the NINTH Monday OF THE SECOND SEMESTER (10 April) nominations for the election of Academic Staff by the General Assembly to the Court, the Council and the Senate.

 

(ii)

Candidates for election shall be eligible for nomination in accordance with the provisions of Statutes XII, XIII and XIV and provided that their names are enrolled in one of the current Electoral Rolls of the University.

 

(iii)

Nominations of candidates in each election shall be receivable until noon on the FOURTEENTH working day (3 March, 24 March, 15 May) following the publication of the call for nominations EXCLUDING DAYS FALLING IN VACATIONS AND UNIVERSITY CLOSURES. If the number of valid nominations exceeds the number of vacancies, a ballot shall be arranged in a manner approved by the Court, the Council or the Senate as the case may be.

8.

 

Elections to fill casual vacancies on the Court, the Council and the Senate shall be conducted with the use and upon the basis of the annual Electoral Rolls then current.

 

 


ANNEX B

Ordinance XXX. Concerning the Composition of the Senate

the Academic and other Staff of the University, by the General Assembly
and by Students of the University.

The composition of the Senate shall be in accordance with Statute XIV paragraph 1.

of the staff of the University excluding all those who are members of the
Academic Staff for the purpose of electing:

 

 

(a) four from their own number to the Court pursuant Statute XII sub

(iv)

of the students of the University in each Faculty for the purpose of
electing one student from each Faculty to Senate pursuant Statute XIV

(i)

Draft Electoral Rolls of the General Assembly, the Academic Staff
and other staff of the University shall be published each year on the
third Wednesday before the last day of the teaching period prior to the
Easter vacation and shall be available for inspection until the penultimate
Friday of the teaching period prior to the Easter Vacation.

 

(ii)

Draft Electoral Rolls of the students of the University shall be published
each year on the penultimate Wednesday of the teaching period prior to
the Christmas Vacation and shall be available for inspection until
the last day of the teaching period prior to the Christmas Vacation.

 

(iii)

Thereafter the Manager of Academic Registry shall cause to be
corrected all errors therein and all omissions therefrom which have
been drawn to his attention and the draft Electoral Rolls thus amended
shall be those from which elections to the Court, the Council and Senate
shall be conducted.

(i)

Each year before the commencement of the teaching period after the
Easter Vacation the Manager of Academic Registry shall announce
the number of elected members of the Senate from Faculties for the year
beginning 1 August next following, and the Faculty for the year beginning
1 August next following, and the least number of professors thereamong
who shall be required to be elected pursuant para 2 of this Ordinance.

 

(ii)

For the purpose of calculating these numbers:

 

 

(a)
he/she shall take the number of ex-officio members of
Senate specified in sub. para. 1(i)(e) of Statute XIV

the overriding provisions of this paragraph and the method
of dividing them shall be in accordance with the method
prescribed in sub. para 5(ii)(c) hereof.

 

(iv)

If by the calculation to the nearest integer of the number of members
of Senate from Faculties specified in para. 5(ii) hereof, the aggregate of
the elected members of Senate thereby resulting shall exceed or
fall short of the number of elected members specified in sub.
para. 1(iii)(b) of Statute XIV, the number shall be adjusted as follows:

 

 

(a) if the number falls to be reduced, one place shall be removed from
the quota of that Faculty having the largest quota of elected members
insofar as that quota has been achieved by rounding up.

 

 

(b) if the number falls to be increased, one place shall be added to
the quota of that Faculty having the smallest quota of elected
members other than any quota which has been increased to three

(i)

The elections of students of the University to Senate with effect
from 1 August shall be conducted each year in the teaching period
prior to the Easter Vacation.

 

(ii)

Arrangements for the call and return of nominations and for any
necessary ballot shall be determined by the Manager of Academic
Registry in consultation with the Sabbatical Secretary of the Students'
Union, provided that in each election the period for the return of
nominations shall be not less than ten days.

 

(iii)

Candidates for election shall be eligible for nominations in accordance
with the
provisions of Statue XIV and provided that their names are enrolled
in the current Electoral Roll of the students of the University.

(i)

Nominations of staff candidates for election to the Court, the Council
and the Senate with effect from 1 August shall be called for
each year as follows:

 

 

(a) on the first Monday, except when this is a Bank Holiday, in
which case on the first Tuesday in the teaching period after the
Easter Vacation, nominations for the election of Academic Staff
from the Faculties to the Senate;

 

 

(b) on the fourth Monday, except when this is a Bank Holiday, in
which case on the fourth Tuesday in the teaching period after the
Easter vacation, nominations for the election of staff of the
University not being members of the Academic Staff
to the Court and the Council;

 

 

(c) on the sixth Monday, except when this is a Bank Holiday, in
which case on the sixth Tuesday in the teaching period after
the Easter Vacation, nominations for the election of Academic
Staff by the General Assembly to the Court, the Council
and the Senate.

 

(ii)

Candidates for election shall be eligible for nomination in accordance
with the provisions of Statutes XII, XIII and XIV and provided
that their names are enrolled in one of the current Electoral
Rolls of the University.

 

(iii)

Nominations of candidates in each election shall be receivable
until noon on the eighth working day following the publication
of the call for nominations. If the number of valid nominations exceeds
the number of vacancies, a ballot shall be arranged in a manner
approved by the Court, the Council or the Senate as the case may be.
